Terms & Conditions
Please read these terms carefully. They explain the rules for using our website and the general terms on which we provide our services.
Last updated: October 20, 20261. Acceptance of these terms
These Terms & Conditions (“Terms”) apply to your use of ascentrixmarketing.com and to services provided by Ascentrix Marketing (“Ascentrix Marketing”, “we”, “us”). By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website.
2. Our services
We provide digital marketing services including search engine optimization, paid advertising management, social media marketing, content marketing, email marketing, web design and branding. The specific scope, deliverables, fees and timelines for each client are set out in a separate proposal, statement of work or service agreement (“Agreement”). If an Agreement conflicts with these Terms, the Agreement takes priority.
3. Use of this website
- You may use this website for lawful purposes only.
- You must not attempt to gain unauthorised access to the website, introduce malware or interfere with its operation.
- Content on this website is provided for general information and does not constitute professional advice for your specific situation.
- We may update, suspend or withdraw any part of the website without notice.
4. Fees and payment
Fees are set out in your Agreement or on our pricing page. Unless otherwise agreed, monthly fees are invoiced in advance and payable within 7 days of the invoice date. Prices exclude applicable taxes such as VAT, GST or sales tax. Advertising spend is paid directly by you to the relevant platform and is not included in our fees. Late payments may result in suspension of services.
5. Client responsibilities
To help us deliver results, you agree to provide timely access to relevant accounts, accurate information about your business, prompt feedback and approvals, and any content or materials we reasonably request. You are responsible for ensuring that information and materials you provide do not infringe any third party's rights and comply with applicable laws and advertising regulations for your industry.
6. Intellectual property
All content on this website, including text, graphics, logos and design, belongs to Ascentrix Marketing or its licensors and may not be copied without permission. Ownership of work we create for clients is set out in the relevant Agreement; unless agreed otherwise, ownership of final deliverables transfers to the client once all related fees have been paid in full. We retain ownership of our pre-existing tools, templates, methods and know-how.
7. Third-party platforms
Our services rely on third-party platforms such as Google, Meta, LinkedIn, TikTok, website hosts and email providers. These platforms control their own algorithms, policies, pricing and availability, which may change at any time. We are not responsible for platform outages, policy changes, ad disapprovals or account suspensions outside our reasonable control, although we will always work to resolve them on your behalf.
8. No guarantee of specific results
We use proven strategies and our best professional efforts, but marketing outcomes depend on many factors outside our control, including competition, market conditions and third-party algorithms. We therefore do not guarantee specific rankings, traffic, leads, sales or return on ad spend. Case studies and results shown on this website are illustrations of past performance and are not a promise of future results.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of profits, revenue, data or business opportunity. Our total liability arising from any services is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You agree to indemnify us against claims arising from materials you supply, your breach of these Terms or your violation of any law or third-party rights.
11. Confidentiality
Each party will keep confidential any non-public information received from the other and use it only to perform the services. This obligation continues after the end of our relationship.
12. Termination
Either party may end an ongoing engagement by giving the notice period stated in the Agreement (or 30 days' written notice if none is stated). Fees for work completed up to the termination date remain payable. See our Refund Policy for details on cancellations and refunds.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Ascentrix Marketing is registered, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, unless local consumer law gives you the right to bring proceedings elsewhere.
14. Changes to these terms
We may update these Terms from time to time. The version published on this page applies to your use of the website from the date it is posted.
